Where's The Kid — Terms of Use

Last updated: 21 October 2026 Version: 2026-10-21 Operator: EZ Dev (Israel), https://zedeasydev.com Contact: contact@zedeasydev.com

These Terms of Use ("Terms") are a binding agreement between you ("you") and EZ Dev ("we", "us"), the operator of the Where's The Kid Android app (in Hebrew: איפה הילד) and the website at https://wheresthekid.app (together, the "Service"). By installing, signing in to or using the Service, you agree to these Terms, to our Privacy Policy and to our Safety Disclaimer. If you do not agree, do not use the Service.

TL;DR

1. Nature of the Service

Please read sections 1, 2, 7, 8, 9, 10 and 11 carefully. They limit our responsibility and set out yours.

1.1 What the Service does. The Service lets parents confirm that their child has been dropped off at daycare, or taken out of the car, by a deadline. If no one confirms in time, it sends reminders and escalating alerts (push notifications, WhatsApp and email; SMS and voice calls are not available for now, see section 4.3) to the parents and, if you set them up, to emergency contacts and the daycare.

1.2 A reminder and notification aid only. The Service is a reminder and notification aid. It does not detect, sense, monitor or locate a child, uses no sensors and no connection to your vehicle, and does not know where your child or your car is. It only knows whether someone confirmed a check in time. If you turn on the optional location reminders, your phone's geofencing can notice that the phone arrived at a daycare place or left home and prompt you; this never locates your child, can fail like any other alert, and is not monitoring of any kind. It is not a safety device, sensor or monitoring system.

1.3 Not an emergency service. The Service is not an emergency service. It does not contact the police, ambulance or any other emergency service on your behalf.

1.4 Not a statutory device. Where's The Kid is not an approved child-presence alert device as required by law in some countries (including Israel and Italy) and does not exempt anyone from installing one where required. You must comply with any such law regardless of the Service.

1.5 It does not replace you. The Service never replaces active parental supervision, your own attention and responsibility, or checking the car every time you leave it.

2. Your responsibilities

2.1 You alone are responsible for your child's safety and supervision at all times, whether or not the Service is installed, configured or working.

2.2 For the Service to have a fair chance of reaching you, you must at all times:

(a) enter correct and current email addresses and WhatsApp numbers for yourself, the other parent and every contact; (b) keep notifications and the permissions the app requests enabled, and exempt the app from battery optimisation and do-not-disturb where your device allows; (c) keep your phone charged, switched on and connected to a mobile network or the internet, and keep the app installed and updated; (d) set a correct schedule, deadline and time zone for each child, and update them when routines change (holidays, illness, a different person doing the drop-off); (e) if you use location reminders, keep your places correct and location permission on, and never treat a missing location reminder as a sign that your child is safe; (f) test your alerts with the in-app Test alert after setup and after every change to phones, numbers, schedules, contacts or settings, and review your escalation settings; (g) obtain the consent of each emergency contact and daycare contact before you add them, and remove them when they ask.

2.3 You are responsible for the consequences of any failure to do the above.

3. Eligibility and account

3.1 You must be at least 18 years old and a parent or legal guardian, or a person authorised by them, to use the Service. The Service is not intended for use by children.

3.2 You sign in with your Google account. You are responsible for activity under your account and for keeping access to your Google account secure.

3.3 A family may include two parents. A parent can invite the second parent by code. Both parents can see the family's children, schedules, contacts and check logs. Invite only a person you trust with this information. Each parent who joins accepts these Terms.

4. Price and advertising

4.1 Free. The Service is currently provided free of charge. There is no subscription, trial or paid plan, and we do not charge you through Google Play.

4.2 Advertising. To keep the Service free, the app shows advertising served by Google AdMob on some quiet screens (such as Settings, the alert history, Children and Family). We never show ads on alert or confirmation screens, during onboarding, or while a check is escalating. Where the law requires it (for example in the EEA and the UK), you are asked for consent before personalised ads are shown; otherwise you see non-personalised ads. How ad data is processed is described in the Privacy Policy. Advertisers, not we, are responsible for their ads and for the products and services they offer; any dealings you have with an advertiser are between you and that advertiser.

4.3 Channels not available for now. SMS text messages and voice calls are not available in the free version for now. Alerts are sent by push notification, WhatsApp and email.

4.4 Future paid features. We may offer paid features in the future. If we do, they will be optional and offered under separate terms that you accept before you buy.

5. Acceptable use

You agree not to:

(a) use the Service for any purpose other than the safety of a child in your care, for example to send messages or calls to people for other reasons; (b) harass, spam or disturb any person, or add as a contact anyone who has not agreed to be contacted; (c) enter phone numbers or details of people without their permission, or false or misleading information; (d) trigger alerts deliberately to bother other people, or test alerts in a way that burdens daycare staff or contacts; (e) interfere with, reverse engineer, overload or attempt to gain unauthorised access to the Service, or tamper with the ads (including fraudulent or automated ad clicks); (f) use the Service in breach of any law.

We may suspend or end your access if you breach this section, and we may stop messages to a contact who asks us to.

6. Licence and intellectual property

6.1 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, for your family's personal, non-commercial use.

6.2 The Service, its software, design and content, and the Where's The Kid / איפה הילד names and logos belong to us or our licensors. All rights not expressly granted are reserved.

6.3 You keep any rights you have in the information you enter. You allow us to use it only to provide the Service, as described in the Privacy Policy.

6.4 Google Play's terms also apply to your download. Google is not responsible for the Service.

7. Third-party services and availability

7.1 Third-party dependencies. The Service depends on systems and providers that we do not own or control, including: mobile networks; Twilio (WhatsApp delivery); SendGrid and Amazon Web Services (email and hosting); Google (Sign-In, Google Play, Firebase push notifications and AdMob advertising); WhatsApp; your device's location services and the Android Geofencing API, if you use location reminders; internet connectivity; and your device, its manufacturer and its operating system, including power-saving, battery-optimisation, do-not-disturb, spam-filtering and call-blocking features.

7.2 Outside our control. Outages, delays, filtering, blocking, throttling, rate limits, number or sender-ID restrictions and other failures of any of these systems are outside our control, and any of them can cause an alert to be delayed, not delivered or not noticed. We are not responsible for them.

7.3 Availability. We work to keep the Service running reliably, but it may be unavailable for maintenance, updates or faults. We may change, suspend or discontinue features. If we discontinue the Service as a whole, we will give reasonable notice where possible.

8. NO WARRANTY

8.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.2 WE DO NOT WARRANT THAT ANY REMINDER, MESSAGE, CALL OR NOTIFICATION WILL BE SENT, DELIVERED, DELIVERED ON TIME, RECEIVED OR NOTICED, OR THAT THE SERVICE WILL OPERATE UNINTERRUPTED, SECURELY OR ERROR-FREE.

8.3 WE DO NOT WARRANT THAT THE SERVICE WILL PREVENT ANY CHILD FROM BEING FORGOTTEN, LEFT IN A VEHICLE OR HARMED. Sections 1, 2 and 7 describe the limits of the Service, and you accept them.

9. LIMITATION OF LIABILITY

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER EZ DEV NOR ITS OWNERS, EMPLOYEES, CONTRACTORS OR SUPPLIERS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BODILY INJURY, ILLNESS OR DEATH, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO:

(a) A CHILD BEING FORGOTTEN, LEFT IN A VEHICLE OR NOT DROPPED OFF; (b) A REMINDER, MESSAGE, CALL OR NOTIFICATION THAT WAS MISSED, DELAYED, NOT DELIVERED, NOT NOTICED OR FAILED FOR ANY REASON; (c) ANY FAILURE OF A THIRD-PARTY SERVICE, NETWORK OR DEVICE DESCRIBED IN SECTION 7; (d) INCORRECT, INCOMPLETE OR OUTDATED INFORMATION OR SETTINGS ENTERED BY YOU OR ANOTHER FAMILY MEMBER, OR YOUR FAILURE TO MEET YOUR RESPONSIBILITIES UNDER SECTION 2; OR (e) ANY USE OF, OR INABILITY TO USE, THE SERVICE,

WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE FEES, IF ANY, YOU ACTUALLY PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

9.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our gross negligence or wilful misconduct, or your mandatory rights as a consumer. Where the law does not allow an exclusion or limitation in full, it applies to the fullest extent the law allows.

10. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless EZ Dev and its owners, employees and contractors from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) brought by a third party, including your contacts, the other parent or a daycare, arising from: (a) your use of the Service; (b) the information, numbers and settings you enter; (c) your adding people as contacts without their consent; or (d) your breach of these Terms or of any law.

11. Emergencies

If a child may be in danger, call your local emergency number immediately (in Israel: Magen David Adom 101, Police 100, or 112). Never wait for an alert from the Service, and never rely on the Service instead of calling for help.

12. Your acknowledgement and acceptance

12.1 When you sign up, you must actively accept these Terms, the Privacy Policy and the Safety Disclaimer, and confirm that you understand that Where's The Kid is an aid only, that alerts may be delayed or fail, and that you remain fully and solely responsible for your child's safety.

12.2 We record your acceptance, including the version of these Terms you accepted and the date and time of acceptance.

12.3 If we make a material change to these Terms, you will be asked to accept the new version again before you continue to use the Service.

13. Termination

13.1 You may stop using the Service and delete your account at any time (Settings → Delete account, or https://wheresthekid.app/en/delete-account/).

13.2 We may suspend or end your access if you materially breach these Terms or if required by law. Where reasonable, we will notify you first.

13.3 Sections that by their nature should survive termination (including sections 2, 7, 8, 9, 10 and 15) survive.

14. Changes to these Terms

We may update these Terms. We will change the "last updated" date and version above and, for material changes, notify you in the app or by email before they take effect and ask you to accept the new version (section 12.3). If you do not accept them, stop using the Service.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts in Tel Aviv-Yafo have exclusive jurisdiction over any dispute, except where mandatory consumer protection law gives you the right to bring a claim in your place of residence.

16. General

16.1 If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible, and the rest remain in effect. 16.2 Our failure to enforce a provision is not a waiver of it. 16.3 You may not transfer your rights under these Terms. We may transfer ours as part of a reorganisation or sale of the Service, with notice to you. 16.4 These Terms, the Privacy Policy and the Safety Disclaimer are the entire agreement between you and us about the Service.

17. Language

These Terms are published in English and Hebrew. The English version is the governing text; if the versions differ, the English version prevails.
